This limit applies per month and per employee. If it is exceeded by even one cent, the full amount becomes taxable. Important: this is an exemption threshold, not an allowance.
• €60 for personal occasions: In addition to the monthly exemption threshold for benefits in kind, small gifts for personal occasions—such as a birthday, wedding, birth of a child or anniversary—remain tax-exempt up to a gross value of €60 per occasion. If an employee has both a birthday and a work anniversary in one month, two gifts of €60 each may be given.
• Within the benefit-in-kind exemption threshold (up to €50 per month): The gift remains entirely exempt from tax and social-security contributions for both employer and employee.
• Small gifts for personal occasions (up to €60): These are also tax-exempt, provided there is a specific personal occasion and the €60 limit is observed.
• Above the exemption thresholds: If an exemption threshold is exceeded, the entire amount is subject to wage tax and social-security contributions. Alternatively, the employer may assume a flat-rate tax of 30 per cent under Section 37b of the German Income Tax Act, leaving the gift tax-free for the employee.
• Tip for HR and procurement: Document the occasion, recipient and gross value for every gift. Especially for small gifts on personal occasions, allocating the gift to the specific event is crucial to tax exemption.
